On April 24, 2023, EPN submitted comments regarding EPA’s and FDA’s proposal to modernize the approach to the oversight of certain pesticides or new animal drugs. EPN recommends that most of these products—those applied to animals and currently regulated by EPA—should remain subject to FIFRA as EPA not only has clear legal authority, but also the expertise and resources to address the risks such products might pose. We also suggest that both agencies draw a jurisdictional line between which agency would better regulate a particular product based on expertise, resources, and scope of legal authority. In addition, we recommend the agencies think about how to manage the transition for products that move to a new regulator and create a portal where the regulated community can get timely answers to questions.
