On April 7, 2022, EPN submitted comments on EPA’s proposal to restore the determination that it is “appropriate and necessary” to curb releases of mercury, arsenic, and other hazardous air pollutants (HAPs) from coal- and oil-fired power plants under the Mercury and Air Toxics Standards (MATS). EPN strongly supports EPA’s decision, as this finding will reduce pollution and better protect public health. However, EPN urged EPA to strengthen this proposal by updating its cost benefit analysis (CBA) in the final rule to avoid ongoing legal challenges and make clear to the public why MATS is so important to their health.
