On December 20, 2019, EPN submitted a letter in response to EPA’s proposal to revise the Environmental Appeals Board (EAB) review process—a process that is not broken and does not need fixing. The EAB is the final decision maker on administrative appeals under all major environmental statutes that EPA administers. The proposal favors speed of resolution for the permit holder at the expense of the public’s opportunity to raise issues, and would allow political leadership to interfere with what has traditionally been an impartial and reliable agency activity.
