On Monday, July 3, 2023, EPN sent a letter to the U.S. Senate Committee on Environment and Public Works regarding draft PFAS legislation. Although EPN feels that the proposed legislation would provide a more comprehensive, science-based framework to address PFAS contamination, we have concerns that the narrow definition of PFAS used in the bill will permit at least 40% of the PFAS present in the U.S. environment to remain unregulated. We are also concerned that the amended bill will include Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) exemptions for PFAS for certain industry categories, which would delay cleanups while prolonging health risks from PFAS.
