On October 19, 2020, EPN submitted comments on EPA’s proposed 2020 Financial Capability Assessment (FCA) for Clean Water Act (CWA) obligations. The FCA guidance, which has not been updated in more than 20 years, is used to evaluate the financial capability of communities when they develop plans for water infrastructure improvements. EPN raised concerns and made recommended changes to address the likelihood that more projects will be allowed extended schedules to come into compliance with CWA requirements under the proposed guidance, and that time extensions are likely to be longer. Prompt compliance with violations of clean water laws is essential to protecting environmental quality and public health and safety, especially for low-income communities.
